3. Purposes and Legal Bases of Processing
We process your personal data in accordance with the provisions of the Datenschutz-Grundverordnung (DSGVO) and the Bundesdatenschutzgesetz (BDSG), as far as necessary for deciding on the establishment of an employment relationship with us. The legal basis is Art. 88 DSGVO in conjunction with § 26 BDSG, and possibly Art. 6(1)(b) DSGVO for initiating or performing contractual relationships. We may also process your personal data to fulfill legal obligations (Art. 6(1)(c) DSGVO) or defend against legal claims (Art. 6(1)(f) DSGVO), such as the need for evidence in a proceeding under the Allgemeinen Gleichbehandlungsgesetz (AGG). If you provide explicit consent for processing personal data for specific purposes, the legality of such processing is based on your consent under Art. 6(1)(a) DSGVO. Consent can be revoked at any time for the future (see Section 9 of this data protection information). If an employment relationship is established, we may continue processing your personal data for the purposes of the employment relationship in accordance with Art. 88 DSGVO in conjunction with § 26 BDSG.

4. Categories of Personal Data
We only process data related to your application, including general personal information (name, address, contact details, etc.), details of your professional qualifications and education, information about professional development, and any other data you provide in connection with your application.

5. Sources of Data
We process personal data received from you through the application portal of d.vinci HR-Systems GmbH, postal mail, email, or other agency portals or marketing service providers.

6. Recipients of Data
We only share your personal data within our company with departments and individuals who need the data to fulfill contractual and legal obligations or to pursue our legitimate interests. We may transfer your personal data to affiliated companies in the X1F group for the purposes and legal bases outlined in Section 3 of this data protection information. Data transfer to external recipients outside the company only occurs if permitted or required by law, if necessary to fulfill legal obligations, or with your consent.

7. Transfer to a Third Country
There is no intention to transfer data to a third country.

8. Duration of Data Storage
We store your personal data for the duration necessary to decide on your application. Your personal data or application documents will be deleted no later than six months after the end of the application process (e.g., the announcement of the rejection decision), unless longer storage is legally required or permissible. We only store your personal data beyond this period if necessary for legal requirements or for the duration of a legal dispute. If you have agreed to longer storage of your personal data, we will store it according to your consent. In the event of an employment, training, or internship relationship following the application process, your data may be stored initially and then transferred to the personnel file, as necessary and permissible.

9. Your Rights
You have the right to information (Art. 15 DSGVO), correction (Art. 16 DSGVO), deletion (Art. 17 DSGVO), restriction of processing (Art. 18 DSGVO), notification (Art. 19 DSGVO), and data portability (Art. 20 DSGVO). Additionally, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 DSGVO) if you believe that the processing of your personal data is not lawful. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy. If data processing is based on your consent, you have the right to withdraw your consent at any time (Art. 7 DSGVO). Please note that the revocation only applies to the future. Processing that occurred before the revocation is not affected. Also, certain data may need to be retained for legal requirements (see Section 8 of this data protection information).

10. Necessity of Providing Personal Data
Providing personal data in the context of application processes is neither legally nor contractually required. You are not obligated to provide personal data. However, such information is necessary for the decision on an application or the conclusion of a contract regarding employment with us. If you do not provide personal data, we cannot make a decision on the establishment of an employment relationship. We recommend providing only the personal data necessary for the application process.

11. Automated Decision-Making
As the decision on your application is not based solely on automated processing, no automated individual decision-making within the meaning of Art. 22 DSGVO takes place.
